Code Enforcement
Code enforcement is a municipal service that ensures compliance with local laws and regulations related to property maintenance, zoning, building codes, and other community standards. The primary goal is to promote public health, safety, and welfare by addressing violations that may affect the quality of life in a neighborhood.
There are a variety of complaints and Municipal Code violations that are investigated by Code Enforcement including:
- Building: Unpermitted construction in progress, unpermitted electrical, plumbing or mechanical work, etc.
- Garbage & Recycle Containers: Garbage & recycle containers stored in public view more than 24 hrs prior to, or following collection.
- Housing: Lack of heat, plumbing, or smoke detectors, leaking roof, deteriorated flooring & walls, etc.
- Illegal Occupancy: People living in sheds, unpermitted converted garages, illegal additions, etc.
- Property Maintenance: Storage of trash, furniture, debris, overgrown vegetation or weeds, etc.
- Public Nuisance: Unsecured swimming pools, buildings, construction sites, etc. Signs: A-frame signs, banners, excessive window signs, etc.
- Zoning: Noise, lack of Use Permit or non-compliance with Use Permit, home occupations, auto repair, fences, trees, setback violations, etc.
Code Enforcement encourages voluntary compliance, and most citizens will correct the violation after receiving verbal or written notification of the problem. If voluntary compliance is not achieved, there are several actions that can be taken including:
- Abatement, when the City needs to abate a public nuisance immediately, such as an unsafe building or structure.
- Administrative Citation, with fines beginning at $100 per violation, up to $1000 per violation, per day.
- Criminal Citation, whereby the violator will be issued a criminal citation, has to appear in Court, and faces possible criminal penalties, including jail time.
- Property Lien, in which the City files a ‘Recorded Notice’ on the Title of the property, thereby “clouding” the Title.
