1. BUSINESSES - What businesses are essential?

Essential businesses

Essential businesses include:

• Healthcare Operations and Essential Infrastructure
• Grocery stores, certified farmers’ markets, farm and produce stands, supermarkets, food banks, and convenience and corner stores that sell a significant amount of food, and other establishments engaged in the retail sale of canned food, dry goods, fresh fruits and vegetables, pet supply, fresh meats, fish, and poultry, and any other household consumer products (such as cleaning and personal care products). This includes stores that sell groceries and also sell other non-grocery products, and products necessary to maintaining the habitability, sanitation, and essential operation of residences
• Food cultivation, including farming, livestock, and fishing
• Businesses that provide food, shelter, and social services, and other necessities of life for economically disadvantaged or otherwise needy individuals
• Newspapers, television, radio, and other media services
• Gas stations and auto-supply, auto-repair, and related facilities
• Bicycle repair and supply shops
• Banks and related financial institutions
• Hardware stores
• Plumbers, electricians, exterminators, and other service providers who provide services that are necessary to maintaining the habitability, sanitation, and essential operation of residences, Essential Activities, and Essential Businesses
• Arborists, landscapers, gardeners, and similar service professionals, but only to the limited extent necessary to maintain the habitability, sanitation, operation of businesses or residences, or the safety of residents, employees, or the public (such as fire safety or tree trimming to prevent a dangerous condition), and not for cosmetic or other purposes (such as upkeep)
• Businesses providing mailing and shipping services, including post office boxes
• Educational institutions—including public and private K-12 schools, colleges, and universities—for purposes of facilitating distance learning or performing essential functions, provided that social distancing of six-feet per person is maintained to the greatest extent possible
• Laundromats, dry cleaners, and laundry service providers
• Restaurants and other facilities that prepare and serve food, but only for delivery or carry out.
• Funeral home providers, mortuaries, cemeteries, and crematoriums, to the extent necessary for the transport, preparation, or processing of bodies or remains
• School meals: Schools and other entities that typically provide free food services to students or members of the public may continue to do so under this Order on the condition that the food is provided to students or members of the public on a pick-up and takeaway basis only. Schools and other entities that provide food services under this exemption shall not permit the food to be eaten at the site where it is provided, or at any other gathering site
• Businesses that supply other essential businesses with the support or supplies necessary to operate
• Businesses whose function is primarily to ship or deliver groceries, food, goods or services directly to residences
• Airlines, taxis, rental car companies, ride-hailing services, scooter and bike shares, and other private transportation providers providing transportation services necessary for Essential Activities and other purposes expressly authorized in this Order
• Home-based care for seniors, adults, or children
• Residential facilities and shelters for seniors, adults, and children
• Professional services, such as legal or accounting services, when necessary to assist in compliance with legally mandated activities
• Moving services that facilitate residential or commercial moves that are allowed under this Order
• Childcare facilities providing services that enable employees exempted in this Order to work as permitted

Businesses that do not fall in one of these categories are non-essential.

Any essential business that is open must follow social distancing best practice.

Non-essential businesses

Non-essential businesses must cease all activities at facilities located within the City except minimum basic operations. Operations that can continue include:

• Inventory, ensure security, process payroll, and employee benefits, or for related functions
• Activities that help employees work from their homes
• Sanitation, including janitorial

Employees must maintain a distance of at least 6 feet from each other at all times.

Construction

Most commercial construction projects are non-essential and must stop.

Warehouses and distribution centers

Businesses that supply and ship goods to essential businesses may stay open.

Real estate showings

Real estate agents may only show homes to potential residents via video or livestream. When a virtual showing is not feasible, a single agent may show a home in person only to a maximum of 2 people. Those 2 people must reside in the same household. And the current occupant must not still reside in the home. 

Is this mandatory or is it just guidance?

It is mandatory. This Order is a legal Order issued under the authority of California law. You are required to comply, and it is a misdemeanor crime not to follow the order (although the intent is not for anyone to get into trouble). It is critical for everyone to follow the Order to prevent the spread of COVID-19 and protect themselves, their loved ones, friends, neighbors and the whole community. All persons, businesses, and other entities are required to comply if they do not fall within the exemptions that are specified in the Order.

2. BUSINESSES - What resources are available for local businesses?

The Small Business Administration (SBA) provides Economic Injury Disaster Loans up to $2 million to help meet financial obligations and operating expenses that could have been met had a disaster not occurred. 

Small businesses, small agricultural cooperatives and most private non-profit organizations in Santa Clara County can apply for loans if the SBA determines businesses are unable to obtain credit elsewhere.

3. BUSINESSES - What restaurants are open during this time?

During this time, many of our local restaurants have remained open to serve our community. The Campbell Chamber of Commerce has begun compiling a list of Campbell restaurants open for take-out or delivery. This directory will continue to be updated. Note the date on the cover for the most recent version.

5. ENFORCEMENT - Is the National Guard stopping people in Campbell?

There are no National Guard checkpoints in Campbell.The National Guard nor the Campbell Police are stopping people in Campbell solely on the factor they are out in public. The Campbell Police have issued zero citations based on the order.

Governor Newson announced on March 17th the activation of the California National Guard. The activation is to support any humanitarian mission that arises and to potentially assist in efforts such as food distribution and alternative medical treatment sites. The activation is not for law enforcement support or martial law. 

Please keep in mind the overall goal of these actions are being taken to support the needs to help slow the spread of COVID-19. We will be sure to keep our community updated with correct and relevant information.

6. ENFORCEMENT - Are the Campbell Police issuing citations for violating the County order?

The Campbell Police Department have issued zero citations based on the order. While the County’s shelter in place order is considered a misdemeanor if violated, our officers are focusing on educating the public on the importance of this order and asking for compliance.

Citations will be used as a last resort. If we find a business or group of individuals are failing to comply after being warned, further action will be taken. As this situation is evolving and may change rapidly, the Campbell Police are ready to respond when needed to enforce additional restrictions the order may impose. If you have any concerns, please contact us directly so that we can avoid the spread of rumors that is causing unnecessary fear and confusion. 7. ENFORCEMENT - Where can Campbell residents report non-essential businesses operating in the city?

If you are witnessing a non-essential businesses operating to the public in the City of Campbell please call our Police Department non-emergency line at (408) 866-2101.

If you are not sure if the business is non-essential or if the business is outside of Campbell, the County of Santa Clara District Attorney’s Office has established a phone number and email to report a non-essential business operating in violation of the Order. These violations can be directed to pubhealthreferral@dao.sccgov.org or a voicemail can be left by calling (408) 792-2300.

8. EVICTIONS - What is the City of Campbell's stance on rent and landlord evictions?

The Santa Clara County Board of Supervisors passed an Urgency Ordinance on March 24, 2020, establishing a moratorium on residential and commercial evictions resulting from a substantial loss of income caused by COVID-19. 

The moratorium applies to all cities countywide and is supported by the Governor’s order put in place on March 16, 2020. The County’s moratorium will last until May 31, 2020 and can be extended if the Governor revises his statewide order beyond May 31. 

The County Counsel’s office will soon be issuing a set of frequently asked questions for both landlords and tenants about how the ordinance will be implemented and what the dispute resolution process will be. We will update our community of this information when it becomes available.

The executive order put in place by Governor Newson on March 16, 2020 protects renters and homeowners during the COVID-19 pandemic.

This order waives the time limitations set forth in Penal Code section 396, subdivision (f). However, the order does not relieve a tenant from the obligation to pay rent, or restrict the landlord’s ability to recover rent that is due. These protections are in effect through May 31, 2020, unless extended.

9. SHELTER IN PLACE ORDER - What's the difference between the order set in place for the State of California and the County’s order?

The Governor’s March 19, 2020 Executive Order directing all Californians to stay home, except for essential needs, complements the County of Santa Clara Public Health Department’s existing order that was issued on March 16, 2020. The Governor’s action reinforces the importance of our local order, which remains in effect and will continue to be implemented. 

The Santa Clara County Order is currently set to last until 11:59 pm on April 7, 2020. However, the County Health Officer may choose to adjust the time period depending on more information that emerges from the situation. 

The County has provided helpful information on their website to these questions and more.

10. SHELTER IN PLACE ORDER - What can I leave my house for?

Do not visit friends or family if there is no urgent need. 

Limit exposure. Limit the amount of time you are out of the house. If possible, only have 1 person go out.

Food and medicine

Go to the store to buy food for yourself, those in your home, and anyone else that needs help.

This includes medical supplies at a pharmacy and essential home maintenance supplies at a hardware store.

Businesses selling those items can remain open. Employees of those businesses can keep working to ensure those businesses are operating.

These include:

• Grocery stores
• Corner stores and convenience stores, including liquor stores that sell food
• Farmers’ markets
• Food banks
• Farm and produce stands
• Supermarkets
• Similar food retail establishments
• Big box stores that sell groceries and essentials

You can also travel to pick up free food for children and elderly. 

Stay 6 feet away from other people when you leave your house.

Minimize unnecessary trips

Buy normal quantities of your groceries. You will continue to be able to purchase these items whenever you need them.

Online stores and delivery

Mail and other delivery services to your home can continue to function, as can food delivery services. 

You can place more orders from online stores. Businesses that deliver goods or services directly to residences are essential businesses that may continue to operate.

Other shopping

You can shop for anything related to health care, office supplies, and hardware supplies.

Other essential businesses include:

• Hardware stores

• Laundromats and laundry services

• Banks

• Funeral homes

• Community benefit organizations on a case-by-case basis

• Newspapers, television, radio and other media services

• Veterinary hospitals and clinics 

Order delivery whenever possible.

Plumbing and household services

Plumbers, electricians, and exterminators may keep working and providing their services to the public. 

You can also visit a hardware store to buy supplies for a DIY solution.

Healthcare during the coronavirus outbreak

Do not go to the emergency room of a hospital unless you are having an actual emergency.
